1.Call Meeting to Order: Chairman Bob Berry called the meeting to order at 4:36 pm. Present was Commissioner Karen Pokorny, Daric Smith from the Town of Preston, Rick Pease from Adams County, Ron Johnson from Town of Adams, and Mandy Schwabe from the Village of Friendship. Sue Booth was excused. Also present were members of the Harvester Committee and a few lake district property owners, as well as Nick Ward from Aquarius Systems.. 

2. Open Harvester Bids and Review: Bob Berry opened a bid from Inland Harvester who sent a statement of NO BID for the project. A bid from Aquarius Systems was hand delivered by Nick Ward and was opened. A a summary was shared by Bob Berry detailing two options, the costs and equipment specifications for the harvester replacement project as follows:

Aquarius will purchase all existing Friendship Lake District Harvesting Equipment, specifically 1993 H-420 Harvester S/N L1013; 1993 TRC-12 Trailer Conveyor S/N L1008-2; 2003 HM-420 Harvester S/M X1215; and 2004 TR-23 Standard Trailer S/N XV034 for $50,000.00.  

Aquarius will repair our existing harvesting trailer over the next few months and loan it back for our use in the 2022 season at no additional cost or until the new trailer is available for delivery. This cost is included in Option#2.

A lengthy discussion as well as question and answer period was held between members present, Nick Ward from Aquarius, and the board with discussion specific to the bid as well as equipment.  
It was explained by Nick that Option#2, the HM420 harvester has been in production for the past year and when construction began, the cost for manufacturing components was less than it is today. Ron Johnson wanted a confirmation of the total grant money awarded to Friendship Lake from the DNR Waterways Commission and was confirmed by Karen Pokorny and reported to be $93,467.50.  
The board discussed that now that we have the bid with exact cost to replace harvester and trailer equipment, we would like to have Steve La Valle contact the Waterways Commission to see if any additional grant money would be considered.  


4. Report from the Harvester Management Committee: Chuck Spargo stated that he and a few committee members visited Aquarius recently and were able to see the harvester noted in Option#2 and ready for our project. Chuck Spargo and Mark Weber detailed the harvester equipment specifications. Additionally Chuck shared that he has been in contact with the Town of Adams and the possibility of a long term lease for property to construct a building for our harvesting equipment. Friendship Lake District has been placed on the December 21, 2021 Town of Adams agenda with Chuck Spargo, Bob Berry, and the harvester committee to begin discussion. Rick Pease did have questions for Chuck Spargo specific to the 2022 Friendship Lake District budgeted item for this project as well as tax revenue from the property owners. Chuck Spargo, Chairman of the Financial Advisory Committee stated that the budgeted amount approved by the district property owners at the annual meeting was $240,000.00 for harvester and trailer replacement. Chuck confirmed that with Option#2 bid at a cost of $273,100.00, less the $50,000.00 buy back for our existing equipment we would come in at $223,000.00 and under the approved budgeted amount of $240,000.00.  

5.Motion and Award of Harvester Replacement Equipment Project: Ron Johnson made a motion that Friendship Lake District award the harvester project to Aquarius Systems, Option#2 in the amount of $273,100.00, and was seconded by Mandy Schwabe. The motion was carried unanimously.  

Karen Pokorny made a motion stating that Friendship Lake District agrees to sell our two existing harvesters and trailers to Aquarius in the amount of $50,000.00. The motion was seconded by Ron Johnson, the motion was carried unanimously.

6.Adjournment: Ron Johnson made a motion to adjourn and seconded by Mandy Schwabe, the motion carried unanimously.

Call Meeting to Order: Chairman Bob Berry called the meeting to order at 9:02am. Present were Commissioners Karen Pokorny and Sue Booth. Also present was Ron Johnson from the Town of Adams and Mandy Schwabe from the Village of Friendship. Rick Pease from Adams County did not attend. No representative from the Town of Preston attended.. Also present was Attorney Don Murn, our attorney from the law firm of Axley Brynelson. There were approximately 53 lake district property owners in attendance.

Convene in Closed Session all property owners of the Friendship Lake District under Wisconsin Statute Section 1985(1)(g) - Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved (Litigation Update: Pheiffer v. Friendship Lake District - Acquisition of Friendship Lake Dam - Appeal). Chuck Spargo made a motion to convene in closed session and was seconded by Scott Prochaska, the motion carried unanimously.  

Attorney Don Murn reported on the current status of the Pheiffer appeal, our legal response with expert witnesses, new survey and appraisal reports. Don Murn spent an hour and a half in presentation, discussion, and questions with the members present. Chuck Spargo made a motion to authorize the board of the Friendship Lake District to go to mediation with Chuck Pheiffer and his attorney’s and that the board should use their discretion in a settlement with an amount not to exceed $100,000.00, and secure this settlement payment by financing at One Community Bank. This motion was seconded by Rich Wieloch. A verbal request was asked by Bob Berry, as well as a hand count taken, of the property owners present, the motion carried unanimously.

Reconvene in Open Session Under Wisconsin Statute Section 19.85(2): Chuck Spargo made a motion to reconvene in open session and was seconded by Rich Wieloch, the motion carried unanimously.

Action, if any, arising from closed session: The Friendship Lake Board will go to mediation in response to the Pheiffer Appeal of Compensation of the Friendship Lake Dam. The Friendship Lake Board will secure financing for any settlement and cost with One Community Bank.  

Adjournment: Chuck Spargo made a motion to adjourn and was seconded by Joe Babcock.

Call Meeting to Order: Bob Berry called the meeting to order at 4:30pm on Thursday April 22, 2021. Present were Commissioners Karen Pokorny and Sue Both. Also present was Rick Pease from Adams County and Ron Johnson from the Town of Adams. No representatives were present from the Town of Preston and the Village of Friendship. As a result of the early April 2021 election, no new representatives have been assigned to our board. Also present, via Google Meets was our Attorney, Justin Lessner from the law firm of Axley Brynelson.

Convene in Closed Session under Wisconsin Statute Section 19.85(1)(g) - Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved (Litigation Update: Pfeiffer v. Friendship Lake District – Acquisition of Friendship Lake Dam - Appeal): Bob Berry asked for a motion to convene the Board of Friendship Lake into closed session. Rick Pease made the motion and was seconded by Ron Johnson. The motion was carried unanimously.

Reconvene in Open Session Under Wisconsin Statute Section 19.85(2): Bob Berry asked for a motion to reconvene the Board of Friendship Lake into open session. Ron Johnson made a motion to reconvene and was seconded by Rick Pease. The motion was carried unanimously.
